All marijuana should be moved out of Schedule I, the strictest category of federal drug law.
Since April 2026, marijuana sold under state medical licenses is in the less restrictive Schedule III, while other marijuana, including state-legal recreational sales, remains in Schedule I pending a federal hearing. This would move all marijuana out of Schedule I without making it legal nationwide.
